Acceptance of these terms

This document and the other documents we refer to below make up our House Rules, or what we officially call our Terms of Use (the “Terms” for short).

The Terms are a binding legal contract between you and Forsigo.
This contract sets out your rights and obligations when you use Forsigo.com and the other services provided by Forsigo so please read it carefully. By using one of our services you agree to the terms. If you do not agree to the terms, you may not use our services. Do you agree with us? Great, keep reading!

Your privacy

We know that your personal information is important to you, so it is important to us. Our Privacy Policy details how your information is collected, used and shared when you use our Services. By using our Services, you also agree that we may process your information in the ways detailed in the Privacy Policy.

Both Forsigo and the sellers process members’ personal information (for example, buyer’s name, email address and shipping address) and are therefore considered separate and independent data controllers of buyers’ personal information under EU law. This means that each party is responsible for the personal information it processes in providing For example, if a seller accidentally discloses a buyer’s name and email address when fulfilling another buyer’s order, the seller, and not Forsigo, will be responsible for that unauthorized disclosure.

However, if you (as a seller) and Forsigo are found to be joint data controllers of buyer personal information, and if Forsigo is sued, fined or otherwise incurred expenses because of something you (or have not) done as a joint data controller of buyer personal information, then You agree to defend and indemnify Forsigo.

Your account with Forsigo

You will need to create a Forsigo account to use some of our services. Here are some rules about accounts with Etsy:

You must be 18 years of age or older to use our Services. Minors under the age of 18 and at least 13 may use our Services only through an account owned by a parent or legal guardian with their appropriate approval and direct supervision. Children under the age of 13 are not permitted to use Forsigo or the Services. You are responsible for any account activity that a minor performs on your account, and there may be commercial products or services available that you may want to consider to limit a minor’s access to online material. Be honest with us. Provide accurate information about yourself. Using false information or impersonating another person or company through your account is prohibited.

Choose an appropriate name. If you choose not to use your full name as the name associated with your account, you may not use language that is offensive, vulgar, infringes on anyone’s intellectual property rights, or otherwise violates the Terms.

You are responsible for your account. You are solely responsible for all activity on your account. If you share an account with other people, the person whose financial information is in the account will be ultimately responsible for all activity. If you are registering as a business entity, you personally warrant that you have the authority to agree to the Terms on behalf of the business. Also, your accounts are non-transferable.

Protect your password. As we mentioned above, you are solely responsible for all activity on your account, so it is important to keep your account password secure.

Your Content

Content that you post through our Services is your content (so let’s refer to it as “your content”). We make no claims about it, including anything you post through our Services (like store names, profile pictures, listing pictures, listing descriptions, reviews, comments, videos, usernames, etc.).

Liability for your content. You understand that you are solely responsible for your own content. You represent that you have all necessary rights to all parts of your content and that you are not infringing or infringing any third party rights by posting it.

Permission to use your content. By posting your Content through our Services, you grant Forsigo, and as authorized by Forsigo in its sole discretion, third parties, a license to use it. We do not claim any ownership of your content, but we do have your permission to use it to help Forsigo function and grow. That way, we won’t infringe on any rights you have in your content and can help promote it. For example, you acknowledge and agree that Forisgo may offer you or Forsigo Buyers promotions on the Site, from time to time, that may relate to your or other Forsigo listings.

Rights you grant to Forsigo. (Here is the legal version of the last section). By posting your Content, you grant to Forsigo, and as authorized by Forsigo in its sole discretion, third parties, a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, perpetual license to use, display, edit, Modify, reproduce, distribute, store and make derivative works of your content. This allows us to provide the Services and promote Forsigo, your Forsigo Store, other stores and listings, or the Services in general, in any format and in any channels, including on any Forsigo Services, our partners, or a third-party website or advertising medium. You agree not to assert any moral rights or rights of publicity against us for the use of your content. You also acknowledge our legitimate interest in using it, in accordance with the scope of this license, to the extent that your content contains any personal information.

It sounds like a lot, but it is necessary for us to continue Forsigo. Consider the following examples: if you upload an image or video of a listing on your Forsigo store, we have permission to display it to buyers, and we can resize or enhance it so that it looks good to a mobile buyer; If you post a description in English, we can translate it into French so a buyer in Paris can learn the story behind your item; And if you post a beautiful photo or video of your latest handmade necklace, we can feature it – often along with your shop name and shop photo – on our homepage, one of our blogs or even on a billboard to help promote your Forsigo business.

Report unauthorized content. Forsigo has the utmost respect for intellectual property rights, and is committed to following appropriate legal procedures to remove infringing content from the Services. If your content is alleged to infringe another person’s intellectual property, we will take appropriate action, such as disabling it if we receive a report of infringement consistent with our policies, or terminating your account if you are found to be a repeat infringer. We will let you know if any of this happens.

Inappropriate, false or misleading content. This should be common sense, but there are certain types of content that we do not want published on Forsigo (for legal reasons or otherwise). You agree that you will not post any content that is offensive, threatening, defamatory, obscene, vulgar or offensive or violates our Prohibited Items Policy, Community Policy or any part of our Terms. You also agree not to post any content that is false or misleading or use the Services in a manner that is fraudulent or misleading.

Your use of our services

License to use our services. We grant you a limited, non-exclusive, non-transferable and revocable license to use our services – subject to the following terms and conditions in particular:

Do not use our services to break the law. You agree that you will not violate any law in connection with your use of the Services. This includes any local, state, federal and international laws that may apply to you. For example, it is your responsibility to obtain any permits or licenses that your store requires, and to comply with applicable legal requirements in the relevant jurisdictions. This includes the sale and delivery of your items, such as age verification on delivery, where required by law. You may not sell anything that violates any laws; You must comply with our Sanctions Policy, and you may not engage in fraud (including false claims or notifications of infringement), theft, anti-competitive behavior, threatening behavior, or any other illegal acts or crimes against Forsigo, another Forsigo user, or a third party .

Pay your bills. You are responsible for paying all fees you owe to Forsigo. Except as set forth below, you are also solely responsible for collecting and/or paying applicable taxes for any purchase or sale you make through our Services. If necessary, Forsigo will calculate, collect and remit value added tax or VAT and sales tax. Some countries may refer to VAT using other terms, e.g. Goods and Services Tax (GST), but we will only refer to VAT, GST, and any local sales taxes collectively as “VAT”. Please see this FAQ and our Fees and Payments Policy for more information on taxes, including details of the taxes Forsigo collects and remits from buyers. The fees, bills, taxes and how you can pay them are fully explained in our Fees and Payments Policy.

Do not try to damage our systems. You agree not to disrupt or attempt to disrupt our services, for example by spreading a virus, excessive requests to our site or platform, or other harmful computer code.

Share your ideas. We love your suggestions and ideas! They can help us improve your experience and our services. Any ideas or other materials you submit to Forsigo (not including your content or items you sell through our Services) are considered non-confidential and non-proprietary to you. You grant us a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, perpetual license to use and publish these ideas and materials for any purpose, without compensation to you.

Termination

You can terminate your account with Forsigo at any time from your account settings. You can find more information in this help article. Termination of your account will not affect the availability of some of your content that you posted through the Services prior to termination. Oh, and you’ll still have to pay all the outstanding bills.

Termination by Forsigo. We may terminate or suspend your account (and any accounts that Forsigo establishes associated with your account) and your access to the Services if we have reason to believe that you, your content, or your use of the Services are in violation of our Terms. If we do, it’s important to understand that you have no contractual or legal right to continue using our services, for example, to sell or buy on our site. Generally, Forsigo will notify you that your account has been closed or suspended, unless you have repeatedly violated our terms or we have legal or regulatory reasons that prevent us from notifying you.

If you or Forsigo terminate your account, you may lose any information associated with your account, including your content.

We may terminate the Services Forsigo reserves the right to modify, suspend or terminate any of the Services to you, any or all Users, at any time, for any reason, including those set forth in Forsigo’s policies under these Terms of Use. We will not be liable to you for the effect any changes to the Services will have on you, including your income or ability to generate income through the Services.

Indemnification (and what will happen if we are sued)

We hope this never happens, but if Forsigo is sued or you receive a claim, notice or demand because of something you did (or didn’t do), you agree to defend and indemnify us. That is, without limitation, you will defend, indemnify, indemnify and hold Forsigo harmless from any claim, demand, demand, lawsuit, loss, liability. , or expense of any kind (including reasonable attorney’s fees) arising from your actions, your use (or misuse) of our Services, your violation of the Terms, items you buy or sell through the Services and/or your actual or alleged violation of any law or any Third Party Rights.

Arbitration Agreement and Class Action Waiver

If you are upset with us, let us know, and we will work together in good faith to resolve your issue. But if we cannot resolve it, then you and Forsigo agree to submit our disputes exclusively to binding individual arbitration, and we will not sue each other in court before a judge or jury, except in the limited circumstances described below.

Please read this section carefully, as it affects your rights.

Controversies we will discuss. You and Forsigo agree to binding individual arbitration of all claims arising out of or related to the Services, these and prior versions of the Terms, any product, data or content purchased, sold, offered, accessed, displayed, transmitted or detailed through the Services, and actions or statements of Forsigo or its users, in each and every case, including disputes that arose before the effective date of these terms (each, a “dispute”). The exception is that each of us may (1) file personal claims of right in “small claims” court, as long as these claims remain in small claims court; and (2) seek injunctive relief in court for infringement or misuse of intellectual property rights (such as trademarks, copyrights and patents). All other disputes must be arbitrated, which means that you and Forsigo each waive your right to sue in court and have a trial or jury.

WAIVER OF CLASS AND REPRESENTATIVE CLAIMS. You and Forsigo agree that each of us may bring claims against the other only on an individual basis, and not on a class, representative or collective basis (and each of us waives any right we may have to bring such claims). Each of us may request or receive personal relief only, disputes between us cannot be arbitrated or consolidated with those of any other person or entity. If a court (after exhausting all appeals) decides that any part of this is unenforceable with respect to a particular claim or request for relief (for example, public injunction relief), then that specific claim or request for relief only. Separated from the arbitration and can be litigated in court (but only after the arbitrator issues a ruling on the arbitrable claims and remedies).

Informal dispute resolution. Before submitting to arbitration, you and Forsigo will attempt in good faith to resolve any dispute informally. To begin the dispute process, you must send an individual written notice (“Dispute Notice”) to Forsigos@gmail.com that includes your name, phone number, username and store name (if applicable), and the email address for your account, as well as a description of the dispute and how you would like to resolve it. If Forsigo has a dispute with you, we will send a dispute notice with that information to your account email address. Once a complete dispute notice has been received, the recipient has 60 days to investigate the claims. You and Forsigo will each attend in person and each can bring counsel, but the conference must be individual, even if the same company represents multiple parties. Changes to Terms

We may update these Terms from time to time, including by adding entirely new Terms and deleting existing Terms. If the changes are material, we will notify you in advance by posting the changes through the Services and/or sending an email or notice regarding the changes. Your use of the Services after the effective date of the changes constitutes your acceptance of the updated terms. If you do not agree to the changes, you may close your account.
